The “sitting judge” argument isn’t really relevant for the Supreme Court if other experience shows understanding of the Constitution, and the real role of this Court. Arguing before the Court, as she has done, may indeed reflect more, and better, experience with the Constitution and its application than the experience of Thomas and Roberts has shown.
