In a speech right after returning to his Bedminster, New Jersey, summer golf retreat following his Miami arraignment earlier in the day, Trump even noted that none of the 37 counts even mentioned the Presidential Records Act. Duh! Of course they did not mention the Presidential Records Act — Trump is not being charged under the Presidential Records Act! Trump’s attorneys have not made any such arguments in court, because they are irrelevant to anything Trump is actually charged with.
Thirty-one of the 37 charges are under the ESPIONAGE ACT — the reckless endangerment of National Security through willful, knowing, intentional mishandling of secrets critical to national security. In this case, secrets that included Top Secret (TS); Top Secret requiring review only as Secure Compartmentalized Information (TS/SCI) and even nuclear codes. Some of these classifications are so sensitive that even the president alone cannot de-classify them.
Trump and his cult worshippers keep trying to deflect and change the subject to Hillary Clinton or Hunter Biden (pathetic, desperate attempt at ultimate “whataboutism”), or the documents inadvertently retained by Joe Biden or Mike Pence and immediately returned, not after the National Archives and Records Administration (NARA) demanded, but on their own initiative after they discovered they had them, none of which did anything remotely similar to what Trump did. Even with the level of security of the documents that Trump had, if he had simply returned them when asked, he would never have been charged.
