There is no constitutional requirement to approve a judicial nomination. We have a checks and balance system of government with a legislative, executive and judicial branch. The advice and consent clause was put in the Constitution so that two of the branches (executive and legislative) can have equal say when making an appointment to the third branch (judicial).
There is no requirement to approve any nomination. There is no time frame required to fill a judicial position. There is no magic to having 9 members on the supreme court. It started with six, expanded to as many as 10, and finally settled in at 9.
What was the liberal view when it was thought Bush might get to make a late term appointment? What did democratic Senator Chuck Schumer have to say back in 2007. “We should reverse the presumption of confirmation” and “I will recommend to my colleagues that we should not confirm a Supreme Court nominee except in extraordinary circumstances.”
Seems back then it was OK that the court might go 18 months without a member but it is now bad if it should go 11 months.
