The choice of Trump-appointed judge Matthew Kacsmaryk (who had previously been chief counsel for an anti-choice organization and had written extensively against abortion — hardly impartial) was particularly diabolical. (And yes, the word “diabolical” comes from the same root word as the Spanish “diablo” for devil and represents intentional evil.)
The ruling cast aside all judicial ethics and legal standards.
The plaintiffs, anti-abortion organizations, had no legal standing to sue. None of them had ever been harmed by the abortifacient medication mifepristone.
A single local federal judge does not have the jurisdiction to overrule a specific medical decision by the FDA. A court could overturn the law that creates the FDA and gives it authority to approve drugs, but the actual scientific decision is one of science at the FDA, not a judge.
More specific to the cartoon, the “judge shopping” in this case was egregious and lacking valid jurisdiction. The initiating anti-choice organization is based in Dallas, not Amarillo. But problematic for the religious zealots trying to impose their religious beliefs from the alt-“Christian” Christofascists from the Caliphate of Talibangelistan (aka Y’all Qaeda of Gilead) is that the Dallas District Federal Court has numerous judges and the case would be assigned randomly to one of them and they could not choose which one.
But the Federal District Court in Amarillo only has one single judge, Matthew Kacsmaryk, the anti-abortion extremist and former legal counsel. Any case in that district with its single judge automatically goes to him. He’s the only judge there!
So these anti-choice extremist radicals, none of whom had experienced direct harm, none of which had standing to sue, filed their case outside the district where they are domiciled, where they knew they would get a sympathetic judge. This is not justice, this is judicial manipulation.
